The City of Montgomery’s Finance Department allows residents to have yard sales up to 4 times per year (one per quarter) without obtaining a business license. A business use is established when you exceed that limit.

• Submit complaint to 311 with the address of the location. 311 can be reached by calling 311, 334-625-4636, or by email to 311@montgomeryal.gov.
• A letter will be sent to the property owner and occupant (if not owner occupied) advising them of the regulations above.
• If no other complaints are registered, the case is closed.
• If another complaint is registered, another letter is sent to the property owner and occupant (if not owner occupied), and a Planning Controls staff member will go out and take pictures, if possible.  Oftentimes, yard sales are done on the weekends; therefore we rely on the citizen registering the complaint to provide pictures.
• If we continue to receive complaints, a petition will be filed in municipal court, if we have evidence.
