Privacy fences

Fences and walls may be erected, placed, maintained or grown along a lot line of property zoned for office or residential use, or adjacent thereto, a height not exceeding 7 ft. above the ground, except in R-20-t, R-24-t, PGH-35 and PGH-40 districts where an 8 ft. height limit shall be permitted, provided the main structure has yard space as required by the Zoning Ordinance.  No such fence or wall located in a required front or street side yard shall exceed a height of 3 ft.

  • If a citizen suspects a fence is in violation, submit complaint to 311 and the Planning Controls staff will do research for compliance. 311 can be reached by calling 311, 334-625-4636, or by email to 311@montgomeryal.gov.
  • If we find that the fence is in violation, a building permit usually has not been obtained and a building inspector will leave notice with the property owner/occupant to contact our office.
  • To bring the property into compliance, the property owner/occupant will either need to seek a variance (Board of Adjustment) to maintain the fence as is, or fix the violation to bring the property into compliance.  A building permit is required.
